This Privacy Policy explains how Shyft Digital (“Shyft Digital,” “we,” “us,” or “our”) collects, uses, discloses, and protects information in connection with MyCommunitySite, including the MyCommunitySite.com website, community websites created or hosted through MyCommunitySite, and related software, hosting, features, and services (collectively, the “Service”).
MyCommunitySite is a software-as-a-service platform used by community associations, homeowners associations, condominium associations, cooperatives, property management companies, and similar organizations to create and operate community websites and share information and documents with authorized users.
By accessing or using the Service, you acknowledge the practices described in this Privacy Policy.
1. Who This Privacy Policy Applies To
This Privacy Policy applies to information collected through the Service from:
- community associations and other organizations that subscribe to MyCommunitySite;
- property management companies that purchase or administer MyCommunitySite on behalf of associations;
- board members and association representatives;
- administrators authorized to manage a community website;
- owners, residents, members, tenants, and other authorized users of a community website; and
- visitors to MyCommunitySite.com or other websites operated through the Service.
For purposes of this Privacy Policy, an association, management company, or other organization that purchases or administers the Service may be referred to as a “Customer.”
2. The Roles of Shyft Digital and Our Customers
MyCommunitySite provides technology that allows Customers to create community websites, manage user access, publish information, and upload and share documents and other content.
Customers determine what information and documents are uploaded to their community websites and who is permitted to access that information.
Depending on the circumstances, Shyft Digital may process personal information on behalf of a Customer in order to provide the Service. The applicable Customer remains responsible for decisions concerning the content it uploads, the individuals who may access that content, and its compliance with applicable laws governing its collection, use, disclosure, and retention of information.
Questions concerning why a particular association document or record has been uploaded, who is entitled to access it, or whether information should be disclosed, withheld, or redacted should generally be directed to the applicable association or management company.
Questions concerning the legal requirements applicable to association records or documents should be directed to the association’s legal counsel.
3. Information We Collect
Account and Contact Information
We may collect information such as:
- name;
- email address;
- telephone number;
- mailing address;
- association, community, or management company affiliation;
- unit, property, or account information;
- username and authentication information; and
- administrative role or account permissions.
Customer Content
Customers and their authorized users may upload, store, publish, or share information and documents through the Service.
This may include:
- bylaws and governing documents;
- declarations, rules, and regulations;
- meeting notices, agendas, minutes, and other meeting materials;
- contracts and vendor information;
- financial reports and other financial information;
- forms and notices;
- photographs and community information;
- member communications;
- association records; and
- other documents or information selected by the Customer.
We refer to this information collectively as “Customer Content.”
Shyft Digital processes Customer Content as necessary to provide, host, secure, maintain, and support the Service.
Technical and Usage Information
When you access or use the Service, we may automatically collect information such as:
- Internet Protocol (IP) address;
- browser type and version;
- device type;
- operating system;
- date and time of access;
- pages or features accessed;
- referring URLs;
- approximate geographic location derived from an IP address;
- login and account activity;
- system logs; and
- information concerning errors, performance, and use of the Service.
Communications and Support Information
If you contact us for technical support, billing assistance, or other purposes, we may collect information contained in your communications with us.
This may include your name, email address, account information, the nature of your request, and information necessary to investigate and resolve technical issues.
Billing Information
When a Customer purchases a subscription or other service, we may collect information necessary to administer billing and payments.
Payment transactions may be processed through third-party payment providers. Shyft Digital may not directly receive or store complete payment card information where payment processing is handled by a third party.
4. How We Use Information
We may use information collected through the Service to:
- provide, operate, host, and maintain MyCommunitySite;
- create and manage user accounts;
- authenticate users and manage access permissions;
- host, store, display, transmit, and process Customer Content;
- provide technical support and customer service;
- communicate with Customers and users about their accounts and the Service;
- process subscriptions, billing, and payments;
- monitor the performance, reliability, and security of the Service;
- detect, prevent, and investigate fraud, misuse, security incidents, and unauthorized access;
- troubleshoot technical issues;
- improve and develop Service functionality;
- analyze how the Service is used;
- comply with applicable legal obligations;
- enforce our agreements, including the MyCommunitySite Terms of Service;
- protect the rights, safety, property, and security of Shyft Digital, our Customers, users, and others; and
- carry out other purposes disclosed at the time information is collected.
5. Customer Content and Association Documents
Shyft Digital does not determine which documents or records a Customer should upload to MyCommunitySite.
The Customer is responsible for determining:
- whether a document or other information should be uploaded;
- whether the Customer has authority to upload and disclose the information;
- who should have access to the information;
- whether access should be public or restricted;
- whether information should be redacted or withheld;
- whether information is confidential, privileged, proprietary, or otherwise sensitive; and
- whether disclosure complies with applicable law, governing documents, contracts, and other obligations.
Shyft Digital does not ordinarily review Customer Content to determine whether it contains personal, confidential, legally privileged, or otherwise sensitive information.
Customers should exercise appropriate care before uploading documents containing personal or sensitive information.
MyCommunitySite and Shyft Digital are technology providers and do not provide legal services, legal advice, legal opinions, legal document review, or legal compliance services.
Questions regarding whether a document or record should be uploaded, published, disclosed, withheld, redacted, retained, or made available to particular individuals should be directed to the applicable association’s law firm or other qualified legal counsel.
Technical assistance provided by Shyft Digital regarding how to upload, organize, restrict, display, or remove content does not constitute legal advice.
6. Sensitive Information
Customers should avoid uploading unnecessarily sensitive information.
Unless Shyft Digital has expressly confirmed that a particular feature is designed for such information, Customers should not use MyCommunitySite to store:
- Social Security numbers;
- complete bank account numbers;
- complete payment-card information;
- medical records;
- passwords or authentication credentials;
- government-issued identification numbers; or
- other similarly high-risk information.
Customers are encouraged to redact or remove sensitive information where appropriate before uploading documents to the Service.
7. How We Share Information
We do not sell Customer Content.
Service Providers
We may use third-party companies to help us provide and operate the Service.
These service providers may include:
- cloud hosting and data storage providers;
- website and application infrastructure providers;
- email and communications providers;
- payment processors;
- analytics providers;
- security and monitoring providers;
- technical support providers; and
- other technology vendors.
These providers may access information only as reasonably necessary to perform services for Shyft Digital and are subject to contractual or other obligations concerning the handling of information.
At the Direction of a Customer
We may disclose or make information available when directed or authorized by the applicable Customer.
For example, Customer administrators may configure a community website so that particular documents or information are available to designated owners, residents, board members, administrators, or other users.
Legal Requirements
We may disclose information if we reasonably believe disclosure is necessary to:
- comply with applicable law, regulation, court order, subpoena, or legal process;
- respond to lawful requests from government or regulatory authorities;
- protect our legal rights;
- enforce our agreements;
- investigate fraud, security issues, or unlawful conduct; or
- protect the safety, rights, or property of Shyft Digital, Customers, users, or others.
Business Transactions
If Shyft Digital is involved in a merger, acquisition, financing, reorganization, sale of assets, or similar business transaction, information may be transferred as part of that transaction, subject to applicable law.
8. We Do Not Sell Personal Information
Shyft Digital does not sell personal information or Customer Content in exchange for monetary consideration.
We do not sell association records uploaded to MyCommunitySite.
If our practices change in a manner that triggers additional rights or disclosures under applicable privacy laws, we will update this Privacy Policy as appropriate.
9. Cookies and Similar Technologies
We may use cookies and similar technologies to operate and improve the Service.
Cookies are small files stored on a device that may help us:
- maintain login sessions;
- authenticate users;
- remember preferences;
- improve website functionality;
- understand use of the Service;
- monitor system performance;
- identify technical problems; and
- protect the Service from misuse or unauthorized access.
Some cookies may be necessary for the Service to function properly.
We may also use analytics technologies to better understand how users interact with the Service.
Users may be able to control cookies through their browser settings. Disabling certain cookies may affect the functionality of the Service or prevent certain features from working properly.
10. Data Security
Shyft Digital uses commercially reasonable administrative, technical, and organizational safeguards designed to protect information from unauthorized access, use, alteration, or disclosure.
These safeguards may include access controls, authentication measures, monitoring, backups, and protections used by our infrastructure and service providers.
No internet-based service or method of electronic storage can guarantee absolute security. Accordingly, we cannot guarantee that information will never be accessed, disclosed, altered, lost, or destroyed as a result of a security incident or other event.
Users are responsible for maintaining the confidentiality of their account credentials and should promptly notify us if they suspect unauthorized access to their accounts.
11. Data Retention
We retain information for as long as reasonably necessary to provide the Service, fulfill the purposes described in this Privacy Policy, comply with legal obligations, resolve disputes, enforce agreements, and maintain appropriate business records.
Customer Content generally remains available while the Customer maintains an active subscription.
Following expiration or termination of a subscription, Customers may have a reasonable period to retrieve or export available Customer Content as described in the MyCommunitySite Terms of Service.
After the applicable retrieval period, Customer Content may be deleted from active systems.
Information may remain temporarily in backups or archival systems until those systems are overwritten or deleted in accordance with our normal retention practices.
We may retain certain records for longer periods where reasonably necessary for billing, fraud prevention, security, legal compliance, dispute resolution, or enforcement purposes.
12. Customer Responsibility for Record Retention
MyCommunitySite should not be treated as the Customer’s sole permanent archive for records the Customer is legally or operationally required to maintain.
Customers are responsible for maintaining appropriate independent copies or backups of important association records.
Shyft Digital does not determine how long a Customer is legally required to retain a particular association record.
Questions about legal record-retention requirements should be directed to the association’s law firm or other qualified legal counsel.
13. Access, Correction, and Privacy Requests
Depending on applicable law and the nature of the information involved, individuals may have rights relating to their personal information.
These may include rights to request access to, correction of, or deletion of certain personal information.
Because much of the information processed through MyCommunitySite is provided and controlled by a Customer, individuals seeking to exercise rights relating to Customer Content should generally contact the applicable association or management company first.
For example, requests to:
- change association membership information;
- correct unit or ownership information;
- obtain association records;
- remove an association document;
- change who has access to a document; or
- determine whether particular association records should be disclosed
should generally be directed to the applicable association or management company.
Shyft Digital may assist Customers in responding to appropriate requests when reasonably necessary and technically feasible.
Privacy requests relating directly to information controlled by Shyft Digital may be sent to [PRIVACY EMAIL].
We may need to verify your identity before processing a request.
14. Communications
We may send administrative and transactional communications relating to the Service, including:
- account notices;
- security alerts;
- subscription and billing communications;
- password and authentication messages;
- service announcements; and
- notices concerning changes to our Terms of Service or Privacy Policy.
These communications are generally necessary to provide the Service and may not be subject to marketing opt-out preferences.
We may send marketing or promotional communications where permitted by law. You may opt out of promotional email by using the unsubscribe mechanism provided in the communication or by contacting us.
Opting out of marketing communications will not prevent you from receiving necessary administrative or account-related messages.
15. Links to Third-Party Websites
The Service may contain links to websites, applications, or services operated by third parties.
Shyft Digital does not control and is not responsible for the privacy, security, or content practices of third-party websites or services.
This Privacy Policy does not apply to information collected independently by those third parties.
We encourage users to review the privacy policies of third-party websites and services before providing information to them.
16. Children’s Privacy
MyCommunitySite is intended for use by adult Customers and authorized community users.
The Service is not directed to children under 13, and Shyft Digital does not knowingly collect personal information directly from children under 13 through the Service.
Customers should not create accounts for children or upload children’s personal information unless they have determined that doing so is lawful and appropriate.

17. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our Service, technology, business practices, or legal requirements.
When we make material changes, we may provide notice by email, through the Service, by posting a notice on our website, or through another reasonable method.
The “Last Updated” date at the top of this Privacy Policy indicates when the Policy was most recently revised.
We encourage users to review this Privacy Policy periodically.
18. Relationship to the Terms of Service
This Privacy Policy should be read together with the MyCommunitySite Terms of Service.
If you are a Customer or User of the Service, your access to and use of MyCommunitySite is also governed by those Terms.
Nothing in this Privacy Policy changes the Customer’s responsibility under the Terms of Service for determining what Customer Content is uploaded to MyCommunitySite, who may access that content, or whether particular documents or information may lawfully be disclosed.
